1 - Terms and conditions of use:

Site User Obligations and User agreement between the user (‘User’ , ‘you’ , ‘The client’) and EMADEX ECHANGES ELECTRONIQUES MATRICULE NUMBER : 2264691801( ‘emadex.biz; , ‘we’ , ‘us’) are presented within the POLICY FOR USERS.  You are to be bound to by the present Obligations, including without limitation, when register with the site emadex.biz, you consent to these terms and conditions, without qualification, regulating purchases or purchase orders .

These Policies are regulating and providing directions for orders, payments, delivery, and any occasional refunds of orders.

Any ordering by you is conditional on your acceptance of the Rules and Regulations provided by the here presented Policies which you can access through the link ‘CONDITIONS OF USE ’.

When the User decides to make an Order, we will ask Him information, following our directions, which will be used for His identification. This shall include names, postal addresses, telephone numbers and e-mail. Information about the Third Party to whom Delivery, Purchase Orders shall be made will be also required. The User is responsible for the accuracy of all information provided to EMADEX ECHANGES ELECTRONIQUES..

When the Ordering is confirmed by the User, He has also agreed to the Policies, and will not be able to do further changes. The User must therefore ensure He checks all details regarding the products or order choices, which He will be asked to confirm after a resuming screen area.

The User or the Client shall be receiving a confirmation for His orders in due timing when EMADEX ECHANGES ELECTRONIQUEShas begun processing according to the data provided from its site.   

Only EMADEX ECHANGES ELECTRONIQUESis entitled to the approval or acceptance of any amendment/cancellation.

4 - Payment policies:

All payments shall be made when ordering. The Client must ensure the full payment corresponding to the sales price of each product and including the additional charges for delivering. EMADEX ECHANGES ELECTRONIQUESwill provide the Client with a record of His purchase order which will enable Him to verify the amounts being paid.

EMADEX ECHANGES ELECTRONIQUESmay in its sole discretion disrupt the ordering process and/or pursue with the appropriate disciplinary action in case of refused credit card payment authorization, refused payment by accredited entities, and in any other circumstances of non payment.

EMADEX ECHANGES ELECTRONIQUESexpressly reserves the right to interrupt an order or delivery for a client of which a previous order  had not be fully or partially paid, or with which any dispute settlement is under way.

Late payments due to a credit card payment rejection or other payment failure entitles EMADEX ECHANGES ELECTRONIQUESto charge additional amounts to the owing, considering late fees based on banking rates adding 4 points and applicable from the delivery day and the acting legal clause.

EMADEX ECHANGES ELECTRONIQUESreserves the right to pursue with legal actions all unlawful payment methods and/or to settle disputes related to outstanding balances, while fully paid, adding occasional proceeding charges.

We make every effort to offer you the widest variety of payments method with the highest security.We do not collect financial information about you. We use a third-party electronic payment service provider, PAYPAL (with less than 4% fraud rate), which will process securely your payments.

You will choose your region of residency (North America, Europe …), and make a choice of payment method.

The possible payment methods are the followings:

- Credit Cards : VISA – MASTER CARD – AMERICAN EXPRESS.DalPay Retail is the authorized retailer of products and services from MALAGASY SERVICE LLC. DalPay accepts Visa, Delta, MasterCard, Maestro, JCB and American Express credit and debit cards

- Cash (in Euros or American/Canadian Dollars). You agree that no delivery will be processed until your order has been fully paid. When we received this complete payment, we will then commit to our 24 business hours (a longer period is required for orders outside of Antananarivo) delivery.

The cash shall be gived to your local resident EMADEX ECHANGES ELECTRONIQUESoffice ou partner. (list in "Contact us")

5-The Prices:

Prices is expressed in American and Canadian Dollar and Euro.

Prices may change from time to time. The selling price of a product will be the one applied at the time of the ordering at the site emadex.biz (typographic error not occurring)

Delivery prices are charged to the Client and are billed as a supplement to the selling price.

Before the final registration of each order, the Client will be informed of any additional charge which will be included to the total amount due for the purchase. The client agrees then when confirming the order to pay the full amount due for this purchase. Additional charges shown in the bill will NOT be reviewed after the final registration of an order.

6-The procedures for the delivery:

Processed products, purchase orders and fund transfers through the site emadex.biz shall be delivered in Antananarivo-Madagascar.

For a chargeable delivery specified by the Client, the Client shall also specify an address for delivery at the time of purchase. It will be processed by a transporter which will act when the order has been confirmed and fully paid.

If the Client is absent during the delivery, a note for retrieval at our partner office in Madagascar will be delivered.

The first delivery time at the client specified address will be referred to a complete delivery. The client receiving the delivery note will be signing.

For other areas outside of Antananarivo, EMADEX ECHANGES ELECTRONIQUESdeliver in all regions served by mail and Malagasy Taxi-Brousse. Coupons will be available at the nearest post office. "The recipient will receive a mandate and will be presented at a post office nearest to him" and products, in the taxi-brousse . In all cases, representatives of EMADEX ECHANGES ELECTRONIQUESare responsible to contact the recipient to inform them of the availability of the command and the various modalities for the recovery of the said order.

The order beneficiary is responsible for the ensuring of that the delivered merchandise is conform to the order prior to the signing.

Any non conformity of the delivered merchandise (abnormalities, missing parts, damages …) has to be reported on the delivery note under the ‘’réserves manuscrites’’ portion, with the client signature.

The Client shall make a notification of such non conformity to the transporter within two (2) working days by email.

7-Delivery timing:

The delivery time is 24 business hours (a longer period is required for orders outside of Antananarivo) (Madagascar time)is the article is available in stock and the order fully processed.

The timing of a delivery start at the accomplishment of a full payment.

For exceptional cases ( natural catastrophy, epidemia, strikes, etc.) affecting the delivery process, EMADEX ECHANGES ELECTRONIQUES is indemnified of any liability.

In all cases, the delivery timing is accounted for only if the client has no debt toward EMADEX ECHANGES ELECTRONIQUES..

To the Client shall be granted the option of a replacement product with the same buying price if not a refund in the case of unavailability for a timed delivery by EMADEX ECHANGES ELECTRONIQUES..

8 – Claims - Returns and Cancellations:

Any claim related to errors or/and non conformity of products or purchases shall be formulated to EMADEX ECHANGES ELECTRONIQUESat the latest the next working day of the delivery. A late notification will be rejected. Any claim has to be sent to EMADEX ECHANGES ELECTRONIQUES..

The claim has to be formulated to EMADEX ECHANGES ELECTRONIQUESby email (president@emadex.biz).

Any claim not formulated in accordance with the rules above or the time delivery policy will be discarded and shall indemnify EMADEX ECHANGES ELECTRONIQUESof its liability.

All sales are final but case by case we can accept returns if the client asked it and if the third party or the person which receive the orders returns product at the same conditions as the moment of delivery. We keep right to reject the inquiry if the products are returned in an unacceptable condition.

09- Cooling-off period - reimbursement :

The cooling-off period ends seven working days after the day the goods are received by your family.

You must inform us in writing - by letter, fax or email - of your decision to cancel. Your family or the third party must return the goods delivered in the same conditions as in the delivery. If not, we can't accept cancelation. We will reimburse you within 15 days if the goods returned is in the same condtions as delivered.

10-Proprietary right and responsability :

EMADEX ECHANGES ELECTRONIQUESreserve all proprietary rights of any product, purchase notes or tranfered funds and the Client receive His proprietary rights at the time of full payment. The client is responsible of any risk of loss, damage or destruction until He has received His proprietary rights.

EMADEX ECHANGES ELECTRONIQUESexpressly reserves the right for an immediate retrieving of a delivered order, incurring all eventual charges to the client, if the client has not met His payment obligation.

12-Privacy and amendment rights :

EMADEX ECHANGES ELECTRONIQUESunderstands and respects the importance of your privacy. When the Client order through our Site we protect the Privacy of your confidential informations. In order to serve you and during your relationship with us, we may ask you only personal information necessary for the processing of your order. Your online information we collected is immediately encrypted. Personal information shall be used only with granted permission of the client. The client has rights of Privacy, amendement or suppression of His personal data.

13-Jurisdiction:

These Terms & Policies of Use and all matters arising from or connected with them, are governed by and construed in accordance with the Canadian laws and Canadian authorities have exclusive jurisdiction to settle any dispute, controversy or claim arising from or connected with these Terms & Policies.
